What to do in the event of an automobile accident.
1. Help the injured and call 911.
2. Preserve the evidence.
- Get names, addresses, telephone numbers of potential witnesses before the police arrive (preferably get the other person’s Driver’s License number, social security number, and place of employment because people move, get married, or change their names, etc.)
- Cooperate with the law enforcement officer and tell him/her what happened and who you believe is at fault for the accident, but don’t admit fault yourself.
- Take photographs of your vehicle (and the other vehicle if possible)
- Take photographs of your visible injuries.
Do not speak to an insurance adjuster following an accident, even if it is your own insurance company. You may have to file a claim with your own insurance company and they will use whatever you say against you.
Keep a journal to note your aches and pains and also to document your doctors’ visits.
Call an attorney for advice. Most attorneys will speak to you about your accident without any cost or obligation on your part. You can at least know your rights and the attorney can point you in the right direction.

Wills and Living Trusts
Do you have a Will, Living Will, or a Durable Medical Power of Attorney? If so, are they current?
If you do not have these documents or they are out of date, you may be leaving loved ones with many problems to deal with if you pass unexpectedly or become incapacitated. Your true intentions should be expressed in these documents to ensure that your wishes are carried out and your assets are properly distributed.
A will is a document by which a person directs his or her estate to be distributed upon death. In Arizona, there are specific requirements for a will to be valid, including a minimum of two witnesses and a notary.
A Living Will grants authority to an individual whom you appoint that will make the decision on whether to allow you to pass away gracefully or to keep you alive with the use of life-saving devices, i.e. respirator.
A Durable Medical Power of Attorney grants authority to an individual whom you appoint that will be responsible for making decisions of personal care and welfare if you are unable to make your own decision due to physical or mental illness.
The costs for preparation of your Will, Living Will, or Durable Medical Power of Attorney are minimal compared to the heartache and stress that may arise if a debilitating injury or death should strike you.
